The petitioner apprehends his arrest in a case registered for the offence under Section 406 / 420 of the Indian Penal Code.

As per the prosecution case, the truck of the informant, which was parked in parking place, was fraudulently removed by the accused persons Petitioner is not named in the F.I.R. The truck was entrusted to Patna Nagar Nigam Parivahan Nagar Truck Parab and as such, no offence of breach of trust is made out against this petitioner. The alleged dispute is between the informant and Nagar Nigam. Petitioner is neither employee or contractor of Patna Nagar Nigam Parivahan Nagar Truck Parab. Petitioner has got no concern with Mahavir Crane Service. The truck in

Petitioner is a truck mechanic, having a garage on Pahari Par locality and co-accused Kunal Kumar frequently used to come at his garage for repairing of said truck and always introduced himself as brother of the truck owner. Petitioner claims clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as material available on record and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Patna City, Patna in connection with Agam Kuan P.S. Case No. 302 of 2021, G.R. No. 1271 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
