JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-05-2015 Petitioner being husband of the informant is apprehending his arrest in a case registered for the offences under Sections 494, 498A of the Indian Penal Code. The basic accusation is torture and performing second marriage.
On joint prayer of the parties, the matter was referred to the Mediation Centre of the State Legal Services Authority. The report of the Mediator at Flag-D dated 20.04.2015 reflects that the issue has been settled between the parties. One of the conditions is of making payment of Rs. 2500/- per month to the informant to be deposited in her bank account.
It is submitted by learned counsel for the petitioner that issue has been reconciled and petitioner is
Patna High Court Cr.Misc. No.7676 of 2015 (3) dt.19-05-2015 2/2 maintaining the informant and the children. The contention of the counsel for the petitioner is not being controverted by learned counsel appearing on behalf of the informant. Considering the present stand of the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 344 of 2014.
Let the report of the Mediator at Flag-D be also transmitted to the learned Court below.
