The appellant is the plaintiff in the suit and has filed the present appeal against the judgment and decree of affirmance dismissing the suit.
The plaintiff filed the suit for declaration of title and recovery of possession over the suit land. The defendant claimed his title over the suit premises and denied the assertions made by the plaintiff.
Patna High Court SA No.173 of 2014 dt.09-11-2016 Both the courts below have come to the concurrent finding of fact that the plaintiff has failed to establish his case by cogent evidence. On perusal of impugned judgment of the appellate court below, it transpires that specific finding has been recorded that the plaintiff did not produce any evidence in support of his title and even the witnesses examined on behalf of the plaintiff did not support the case of the plaintiff. The appellate court below affirmed the findings of the trial court on reappraisal of evidence. During the course of submission no perversity or unreasonableness in those findings by the courts below have been shown or established on behalf of the appellant.
Ex consequenti, this Court does not find any substantial question of law arising for consideration in this appeal, which is accordingly, dismissed.
