Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 144, 427 of the Indian Penal Code, 3 of the Explosive Substances Act and 3 of the Damage of Public Property Act.

On 08/09.10.2009 the extremists demolished the pillars of Koilcanal by using explosive. When the police force went to investigate, they came to know about involvement of 56 extremist who have named in the First Information Report. It is submitted by the learned counsel for the petitioner that at the relevant time the petitioner was in Chhatishgarh Jail in connection with another case. Only on suspicion the accusation has been levelled.

The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.14589 of 2015 (2) dt.12-05-2015 consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Deo P.S. Case No. 120 of 2009, pending in the court of learned Chief Judicial Magistrate, Aurangabad.

With this observation this application is disposed of.
