JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2019 This is an application for grant of anticipatory bail in connection with Belchi P. S. Case No. 06 of 2019, disclosing offence under Sections 25(1-b)a/26/35 of the Arms Act. Prosecution case is that one scorpio vehicle was coming and on seeing the police party, one person succeeded in fleeing away and other accused persons arrested, who disclosed the name of the persons, who succeeded in fleeing away. From the search of scorpio vehicle 122 live cartridges were recovered. It further appears that petitioner has criminal antecedent. Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused, there is nothing against him. The police has raided the house of the petitioner and nothing was found from his house. Heard learned A.P.P. also, who has opposed the prayer

Having heard both sides, in view of the facts as discussed above along with criminal antecedent and as the case is pending for investigation, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned court below on its own merit.
