The petitioner is apprehending his arrest in connection with Excise Case No.469 of 2019 registered for offences punishable under Sections 30(a)(c) and d of the Bihar Prohibition and Excise Act, 2016 and amendment, 2018. There is recovery of liquor from the cattle shed. It further appears that the petitioner is accused in other cases also. Submission of the learned counsel for the petitioner is that nothing has been recovered from his house and earlier also he had been made accused and apart from that he has criminal antecedent .

Having heard both sides and in view of the facts and

Patna High Court CR. MISC. No.51223 of 2019(3) dt.13-09-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, he may surrender and make prayer for regular bail which will be considered by the learned court below on its own merit. With the aforesaid direction, this application is dismissed.
