This application for grant of anticipatory bail arises out of K.Hat P. S. case No. 582 of 2013, disclosing offences under Section 379 of the Indian Penal Code.

The petitioner was the driver of the truck bearing registration No. JH 02N-2027, which was used for theft of DUCT and cable which was to be laid for 4 G project work by HFCL. There appears to be specific allegation against the petitioner of his active participation in committing theft of DUCT and cable in huge quantity belonging to the informant's Company. Therefore, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
