The petitioner is in custody since 21.10.2022 in connection with Amarpur P.S. Case No. 573 of 2022 for the offence punishable under Sections 365, 302 and 201 of the I.P.C. lodged on 16.10.2022 by the informant Md. Chhabi. As per the prosecution story, the informant alleged that his son on call went out but later disappeared. Thereafter, his dead body was found.

The allegation against the petitioner is that he was in conversation with Bibi Sabina Khatoon, who had made the last call to the deceased.

Learned APP has pointed out that against the submission made in para 3 that he do not have criminal history

Patna High Court CR. MISC. No.40464 of 2023(2) dt.21-07-2023 2/2 and on perusal of the learned Session's Judge order shows that he has recorded that the petitioner has criminal history. On this ground alone, this court is not inclined to extend him privilege of bail which is accordingly rejected. (Rajiv Roy, J) Jagdish/Jyoti/- U T
