JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379, 120 of the Indian Penal Code, sections 33, 41 and 42 of the Indian Forest Act, 1927, section 4 (1),(1A), 21 of the Mines and Minerals (Development and Regulation) Act and Rule 40(1) of the Bihar Minor and Minerals Concession Rules.

Prosecution case is that the informant being SHO of Dehri police station, on the order of the superior officer, raided the places where crusher unit are being run illegally and found the crusher unit being run and raw materials laying for preparation of stone cheeps. On enquiry from the people, who were present there, they suggested the name of the petitioner, who escaped from the scene.

Though, the petitioner is accused in one other case of similar nature but he is on bail. Nothing has been recovered from the possession of the petitioner.

Considering the suspicious nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Dihri, Rohtas in connection with Dihri (T) P.S. Case No.127/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
