JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Excise. Case No. 172 of 2020 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Two persons, including the petitioner, were apprehended by the police, who were found to be carrying 104.90 liters of India Made Foreign Liquor in an Indica car. It is the petitioner's case that he was unaware of illicit liquor being transported in the said vehicle and that he is neither the owner nor the driver of the car. He is in custody since 16.07.2020. Considering the aforesaid submission, this application is allowed.

No.35806 of 2020(3) dt.20-02-2021 2/2 Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-II-cum-Special Judge (Excise), Gopalganj, in Excise Case No. 172 of 2020. It is, however, observed that if the petitioner is found indulging in similar offence, the prosecution shall be at liberty to approach this Court for cancellation of the bail granted to the petitioner by virtue of the present order.
