JUSTICE RAKESH KUMAR ORAL ORDER 25-07-2016 Heard Sri Harish Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehends his arrest in Fatuha P.S. Case No. 253 of 2015 registered for offence under Sections 406, 420, 379, 34 of the Indian Penal Code, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that petitioner was proprietor of a transport company, which had never loaded the alleged sugar and as such, the petitioner is entitled to be released on anticipatory bail, whereas, on perusal of F.I.R., the Court is satisfied that there is specific accusation against the petitioner and it is not a case for grant of anticipatory bail.
