1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 435 and 504 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioner and similarly situated co-accused Abdul Mannan @ Md. Abdul Mannan has been granted the privilege of anticipatory bail by a learned Co-ordinate Bench by order dated 20.06.2018 in Criminal Miscellaneous No. 30158 of 2018 and Julfkar along with 8 others have been granted the privilege of anticipatory bail
Patna High Court CR. MISC. No.42184 of 2023(2) dt.08-08-2023 2/2 by order dated 17.04.2018 in ABP No. 509 of 2018 passed by the learned Sessions Judge, Katihar.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner and the fact that there is no specific allegation of assault alleged against the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kadwa P.S. Case No. 61 of 2018 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
