This is a petition for grant of anticipatory bail for the offence under Sections 302/34 of the Indian Penal Code. There is allegation that an altercation took place between Sudama Choudhary, the Dewar of the informant and her husband and due to fear the informant closed her husband in a room but Sudama Choudhary broken the lock of the room, pulled out her husband and ordered to cut him with Hasuli. Sudama Choudahry dashed the husband of the informant, who fell down on the ground and became unconscious. When the family members of the informant came to rescue they were also assaulted by the petitioner with lathi and danda. Learned counsel for the petitioner, however,
Patna High Court Cr.Misc. No.10245 of 2015 (3) dt.02-09-2015 contended that though there is allegation of assault but there is no injury report regarding the injury other than the deceased, the husband of the informant.
Having regard to the facts and circumstances of the case, the petitioner above named is directed to be released on bail in the event of his arrest or surrender within a period of four weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-1st Class, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 280 of 2014, subject to the conditions laid down under Section 438(2) of the Cr. P. C.
