JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Forbisganj P.S.Case No.69 of 2016 registered under Sections 147, 148, 149, 341, 342, 324, 307, 380, 504 and 508 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that there is a case and counter case and members of both sides sustained injuries in the scuffle which took place due to land
Patna High Court Cr.Misc. No.21046 of 2016 (2) dt.24-05-2016 2/2 dispute between the parties. It is further submitted that the specific allegation of assault is against co-accused Manoj Bahardar, Kanhaiya Bahardar, Rameshwar Bahardar, Sekilal Bahardar and Ramawati Devi. So far as the petitioners are concerned, they all are ladies and there is no specific overt act alleged against them. Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioners.
Regard being had to the omnibus and general allegation made against the petitioners, namely, Suman Devi, Shobha Devi @ Shova Devi, Buchni Devi, Urmila Devi, Jaso Devi @ Jamo Devi, Mamta Devi and Sulekha Devi, in the event of arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbisganj P.S.Case No. 69 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
