The petitioners, who are in custody since 08.07.2020, seek bail in connection with Manihari P. S. Case No. 197 of 2020, dated 07.07.2020, instituted for the offence under Section 414 of the Indian Penal Code. It appears that the petitioners were caught with a stolen mobile telephone.

The learned counsel for the petitioners has submitted that from the allegation in the F.I.R. no offence can at all be said to have been made out.

No.36032 of 2020(2) dt.27-01-2021 2/2 Considering the nature of accusation and the period of custody of the petitioners, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Manihari P. S. Case No. 197 of 2020. The petition stands allowed.
