2. The petitioner seeks regular bail in connection with S.Tr. No.399 of 2022, arising out of Sadar (Mabbi O.P.) P.S. Case No.285 of 2022 lodged under Section 302 of the IPC which is pending before the District & Additional Sessions Judge-X, Darbhanga.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 18.09.2024 passed in Cr. Misc. No.36172 of 2024 with liberty that he may renew his prayer for bail if trial shall not be concluded within a stipulated period of time.

4. Learned counsel for the petitioner further submits

Patna High Court CR. MISC. No.38307 of 2026(3) dt.24-07-2026 2/2 that the petitioner's antecedent is clean and he is in custody since 27.08.2022. He further submits that progress report of the trial has been called for.

5. Learned APP for the State opposes the prayer for bail and submits that the progress report of the trial has come in this case.

6. Upon perusal of the report, it transpires to this Court that prosecution witness has closed and the case has been fixed for recording of statement of accused persons under Section 313 of the Cr.P.C.

7. In this view of the matter, it transpires to this Court that the case has reached at the stage of Section 313 of the Cr.P.C. and there is no delay in trial if the petitioner shall support in the trial.

8. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the regular bail application of the petitioner is hereby rejected. (Dr. Anshuman, J) Prakashmani/- U T
