2. The petitioner seeks pre-arrest bail in connection with Bishanpur P.S.Case No.118/2022, registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per allegation made in FIR, 14.40 ltrs. of liquor were recovered from the Motorcycle of the petitioner bearing registration No.BR07AG 4078, which was for sale in Arunachal Pradesh..

4. The learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and he has clean antecedent. It is the first offence of the petitioner committed under the Excise Act.

5. Learned APP for the State vehemently opposed the

Patna High Court CR. MISC. No.39795 of 2023(2) dt.28-07-2023 2/2 prayer for grant of pre-arrest bail.

6. Having considered antecedent of the petitioner, the petitioner is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge-1 (Excise Act), Darbhanga in connection with Bishanpur P.S.Case No.118 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
