We have heard learned counsel for the petitioner at length. We find that as fresh NIT has been floated and is in the
Patna High Court CWJC No.15052 of 2021(8) dt.07-04-2022 2/2 process of being allotted to someone else, no cause of action survives in this petition. However, Mr. S D Sanjay, learned senior counsel submits that the earnest money deposited by the petitioner has not been refunded till now, hence a direction be issued for refund of the same.
On a query being put to Mr. Lalit Kishore, learned senior counsel appearing for the respondent nos. 2 to 7, he submits that the application for refund is already pending with the respondents, the same is being processed and the amount in question shall be refunded at the earliest, in any case, not later than three weeks.
The writ petition stands disposed off as not pressed, however, with the aforesaid observations.
