Petitioner apprehends arrest in connection with Marhowrah P.S. Case No. 598 of 2018 registered for the offence punishable under sections 302/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to dirty village politics. There is no eye witness to the alleged occurrence. Post mortem report does not corroborate the allegations levelled. Petitioner has no criminal antecedent and is in custody since 17.12.2018. Learned Addl. P.P. appearing for the State

Patna High Court CR. MISC. No.35438 of 2019(4) dt.11-09-2019 2/2 submits that petitioner is named accused in the first information report and there is direct allegation against him of inflicting knife blow on the brother of the informant. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.
