====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 06-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 353, 427 and 34 of the Indian Penal Code and Sections 4, 6, 10 of the Bihar Conduct of Examination Act.

The informant alleges that on 21.03.2021, during examination of Bihar Police Constable, candidates bearing Roll No. 414030430, 442 and others had thrown their question papers and had torn their O.M.R. sheets and even created ruckus at the Centre.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that the

No.38808 of 2022(2) dt.06-12-2022 2/2 students were agitating when questions were given as the questions were out of the syllabus on account of which a ruckus was created at the Centre and while fleeing, it appears that the Adhar Card of the petitioner fell based on which he came to be implicated in the present case.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Banka P.S. Case No. 204 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
