The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 498A of the Indian Penal Code.

Prosecution case in nutshell is that Complainant Durgi Devi got married with the petitioner on 05.03.2004. But after marriage, her husband and his family members started demanding Rs. 20,000/- cash and one colour T.V. and later on demanded Rs. 2 lacs as dowry. On the non-fulfillment of the same, they tortured to the complainant mentally and physically.

It is further submitted that the present complaint case has been filed on 20.04.2017 and much before institution of the present case, divorce case has been filed by the petitioner in which decree of divorce has been passed.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kishanganj in connection with Complaint Case No. C 280 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
