The petitioners are apprehending their arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 467, 468, 420 and 120(B) of the Indian Penal Code. It is alleged that the complainant purchased 67 decimals of land in Khata No. 90, Plot No. 130 and Khata No. 41, plot no. 129 on 13.02.2012 in which Rajesh Kumar, Bachu Prasad were witnesses to the sale deed. Subsequently, the accused persons including the petitioners claimed the land in question on the basis of forged sale deed.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.12385 of 2015 (2) dt.25-03-2015 2 / 2 petitioners that petitioner no. 1 is a witness to the second sale deed executed by petitioner no. 2 in favour of Jailesh Prasad. The complainant claimed to have purchased the land from the mother of petitioner no. 2 Girija Devi.

Considering the nature of accusation, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Complaint Case No. 144C of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Hilsa, Nalanda, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
