The petitioner apprehends his arrest in Chandi P.S. Case No. 36/2015, registered for the offences punishable under Section 364(A) of the Indian Penal Code. Later on, Section 302 was added.

The informant alleged that his son Santosh Kumar was kidnapped by two criminals who came on motorcycle. During the course of investigation on the basis mobile location Prakash Kumar was apprehended and he is said to have disclosed the name of petitioner and others.

It has come that the petitioner was also talking with Prakash Kumar at the time of kidnapping and during captivity of the victim boy. This is a case of kidnapping with murder and there

Patna High Court Cr.Misc. No.20325 of 2016 (3) dt.19-07-2016 2/2 is circumstantial evidence against the petitioner about his involvement in the case.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
