JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Jahanabad P.S. Case No. 960 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code.

Prosecution story is that while informant was coming to Jahanabad Railway Station the driver of white colour Indica car got him into his car and took Rs.1000/- and ATM card from him by the accused persons. FIR is against unknown persons. It appears that during course of investigation name of petitioner has come in the confessional statement of co-accused in which involvement of the petitioner has also been mentioned. Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against him and he has no criminal antecedent.

Patna High Court CR. MISC. No.36187 of 2019(3) dt.14-08-2019 2/2 Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner stating that apart from confessional statement the investigation is still going on, as such he does not deserve bail.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
