The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406, 467, 471 and 504 of the Indian Penal Code. It is alleged that the petitioner being the Branch Manager of Proficient Group of Bank, Dighwara Branch persuaded the informant to invest in a fixed deposit scheme for 75 month which carries interest of 12.5 %. On assurance of the petitioner the informant deposited a sum of Rs. 50,000/-. and after demand being made by the informant, petitioner did not return the same. It is submitted by the learned counsel for the petitioner that the documents brought on record as

Patna High Court Cr.Misc. No.11593 of 2015 (2) dt.20-03-2015 Annexures 2 and 3 suggest that, maturity amount was paid to the informant. Moreover, there is nothing on the record to suggest any investment was made at the behest of the petitioner and learned Sessions Judge also found that the accusation lacks ingredients of cheating. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Saran at Chapra in connection with Dighwara P.S. Case No. 13 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
