The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 427/34 of the Indian Penal Code. Prosecution case is that the informant came to his house on 11.02.2016 and found the accused persons abusing the family members. On protest being made on the order of coaccused Sheo Shankar Ram, the petitioner assaulted with sword on the head of the informant and thereafter, co-accused Sheo Shankar Ram and Karpoo Ram assaulted the informant with fists, slaps and leg. The motive for the occurrence as alleged is that the accused persons are not allowing the informant to take water from the government hand pump.

No.20322 of 2016 (2) dt.11-05-2016 2/2 It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled and there is no accusation of repeating the blow. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Jamui P.S. Case No.41/2016, pending before the learned CJM, Jamui. With the above observation, this application is, accordingly, disposed off.
