Petitioner apprehends arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.
Informant alleges that his minor daughter aged about 16 years was enticed away by this petitioner. Learned counsel for the petitioner, referring to section 164 Cr.P.C. statement of the victim (Annexure 2), submits that the girl has herself stated that she has solemnized the marriage with the petitioner out of her own sweet will and she is 18 years old and she wants to live with her husband. Petitioner has no criminal antecedent.
Considering the facts of the case, let the petitioner, above named, in the event of his arrest/surrender before the
Patna High Court CR. MISC. No.35246 of 2019(2) dt.29-05-2019 2/2 Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 15, Patna in Phulwari sharif Police Station Case No. 259 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
