The petitioner seeks bail in Dariyapur P.S. Case No. 138/2017, instituted for offence under Section(s) 366(A)/34 of the Indian Penal Code.

It is alleged that daughter of informant was kidnapped by this petitioner along with other accused persons. Petitioner is father of co-accused Nitesh Ram. Learned counsel for petitioner has submitted that victim has given statement under Section 164 Cr.P.C., wherein she has stated that petitioner along with other accused persons were speaking her to perform marriage with Nitesh Ram. Co-accused Nitesh Ram has already been granted bail by a Co-ordinate Bench of this Court vide order dated

Patna High Court CR. MISC. No.38364 of 2019(4) dt.16-08-2019 2/2 08.09.2017 passed in Cr. Misc. No. 39276/2017. Petitioner is in custody since 30.03.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 4th, Chapra, in connection with Dariyapur P.S.
