The petitioner apprehends his arrest in Madhubani Mahila P.S. Case no. 56 of 2014, registered for the offences punishable under Sections 323, 379, 498A, 376/511 of the Indian Penal Code.

The informant made allegation of demand of dowry and torture against her husband and all other family members. The informant in her complaint petition alleged that on 25.06.2014 her father-in-law (the petitioner) tried to outrage her modesty. She further alleged that the petitioner staring at her with bad intention. It is submitted that the petitioner is father-in-law and

Earlier complainant filed a Complaint Petition no. 993 of 2012, but she did not make any sorts of allegations against the petitioners, but in the present case she averred that the petitioner was always staring at her with bad intention.

On the other hand, learned counsel for the informant submits that the Dy. S.P. also supervised the case and found the case true against the petitioner.

It also appears that the complainant has alleged in her complaint petition that her father-in-law (the petitioner) always staring at her with bad intention and on 25.06.2014 the petitioner entered into her house and caught her. The complainant earlier filed Complaint Case no. 993 of 2012 on 27.06.2014 making allegation of torture on account of non-fulfillment of demand of dowry, but she did not whisper even a single word against her father-in-law (the petitioner).

Considering the aforesaid facts that in the present case she made specific allegation that the petitioner was staring at her with bad intention. The marriage was solemnized in the year 2007 and the complainant neither made any allegation against the petitioner in the earlier complaint petition, the petitioner above

No.16146 of 2015 (2) dt.29-04-2015 3/3 named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate, Madhubani in connection with Madhubani Mahila P.S. Case No. 56 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
