JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case under section 307 and other allied sections of the Indian Penal Code. As one of the villagers was run over by a truck, local people blocked the road and on arrival of police party, they set fire to some of the vehicles and even damaged the police vehicle at the instance of accused Mithlesh yadav. People also tried to cause injuries to the informant, the officer in charge of the concerned police station. Police arrested 20 persons at the spot.

The petitioner submits that he has not been arrested at the spot nor the arrested accused persons named him. However, his name has figured in confession of co-accused Jitendra Kumar and Bijendra Kumar. Petitioner has no antecedent and has not committed any overt act.
