The petitioners apprehend their arrest in connection with Kudhani P. S. Case No. 246 of 2017 registered for the offences punishable under Sections 147, 148, 149, 323, 307, 504, 354, 327, 379 of the Indian Penal Code.
Allegedly, the petitioners assaulted the informant with garansa causing injury on his head and bleeding, resulting, he fell down.
Submission is of false implication and that no sharp cut injury has been found on the person of the informant, one injury has been caused on the person of the informant which is caused
Patna High Court Cr.Misc. No.49253 of 2017(2) dt.17-10-2017 2/2 by hard and blunt object and nature of injury is simple vide annexure-3, there is case and counter case and as such the petitioner deserves sympathetic consideration. Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, considering the injury report, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Nayan Kumar, J. M. Ist Class, Muzaffarpur in connection with Kudhani P. S. Case No. 246 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
