2. The defects pointed out by the office are ignored.

Learned counsel appearing on behalf of the State, at the outset, submits that the instant writ application has been filed for a direction upon the Circle Officer, Barbigha, Sheikhpura to comply the order dated 27.09.2023 passed by the DCLR, Sheikhpura in Mutation Appeal No. 87/2022-23 which has been affirmed in revision by the Additional Collector,
Patna High Court CWJC No.10382 of 2025(2) dt.08-07-2025 2/3 Sheikhpura in Mutation Revision Case No. 38 of 2024. Learned State Counsel further submits that from perusal of the order of the DCLR, it would manifest that the same records that the order passed by the Circle Officer in Mutation Case No. 2128R27/2021-22 dated 21.03.2022 is set aside and if the appellant (petitioner herein) applies for seeking mutation in his favour in that event the Circle Officer after carrying a spot inspection in accordance with law shall pass a reasoned order. Learned State Counsel next submits that from perusal of the pleadings made in the instant writ application, it would manifest that it appears that the petitioner after the order passed by the DCLR and the same being affirmed by the Additional Collector has not again moved before the Circle Officer seeking mutation in accordance with law.

Learned counsel appearing on behalf of the petitioner is not in a position to rebut the submission of the learned counsel appearing on behalf of the State, thus, seeks permission to withdraw the writ application with liberty to approach the Circle Officer, Barbigha, Sheikhpura for seeking redressal of his grievance in terms of the order passed by the DCLR.
5. Permission is accorded.
