The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Mahila P.S. Case no. 07 of 2021 instituted for the offence under Sections 504, 506, 406 of the Indian Penal Code and Section 66(B) (C ) (D) and 67 of the IT Act.
As per allegation in the FIR, informant and petitioner are maternal cousin. They performed marriage on 19.4.2017 in the Court, which is a voidable marriage as per the Hindu Marriage Act. It is further alleged that petitioner is having her some objectionable photographs and video and he used to give threatening to the informant to make it viral. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

Informant is a major and since the date of marriage, they are residing as husband and wife. Their marriage certificate is annexed as Annexure-3 to this petition. Petitioner has filed a matrimonial Case No. 288 of 2020 on 18.12.2020 and informatory petition no. 2005 of 2020 on 23.12.2020.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Mahila P.S. Case no. 07 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st class, Patna subject to the conditions as laid down under section 438(2) of the Cr.P.C.
