The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147/149/341/323/354/328/452/380 of the Indian Penal Code and 3/4 of the Prevention of Witch Practices Act, 1999. It is alleged that on the order of co-accused Gosai Sahni petitioner no.1 Bahadur Sahni, pushed the informant on the ground and petitioner no.2 Mohani Sahni pressed nose and face of the informant. It is also alleged that petitioner no.2 forcibly put the dirt in the mouth of the informant as a result the informant got unconscious and started vomiting, when sister of the informant went to rescue she was also assaulted.

It is submitted by learned counsel for the petitioners that for the occurrence of 02.09.2014, the complaint was filed on

Patna High Court Cr.Misc. No.15093 of 2015 (6) dt.14-05-2015 2/2 08.09.2014 which came to be registered as P.S. Case on 05.11.2014. At earlier point of time, the wife of one of the coaccused filed Complaint Case No.438 of 2014 against the present informant levelling accusation under sections 147, 149, 341, 323, 354, 452, 379, 380 of the Indian Penal Code and earlier also the informant lodged Pupri P.S. Case No. 260 of 2014 levelling accusation under section 323, 395 and 397 of the Indian Penal Code in which the Final Form was submitted as the accusation was found false.

Considering the delayed lodging of the case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Pupri P.S. Case No.23 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
