The petitioner apprehends his arrest in a case under Section 365/34 of the Indian Penal Code.

The petitioner had earlier moved this Court for anticipatory bail vide Criminal Misc. No. 3156 of 2015 which was rejected vide order dated 22.01.2015.

It is submitted that later on co-accused Manoj Yadav has been granted anticipatory bail by another Bench of this Court by order dated 06.02.2015 vide Criminal Misc. No. 5154 of 2015.

Considering the fact that the petitioner forcibly took Dr. Santosh Kumar from the hospital while he was on emergency duty to the P.M. C.H., the prayer for anticipatory bail of the

Patna High Court Cr.Misc. No.12894 of 2015 (2) dt.08-04-2015 petitioner was rejected.

I do not find any fresh ground for reconsideration of the prayer for grant of anticipatory bail to the petitioner in connection with Madhepura P.S. Case No. 505/2014 pending in the court of the Chief Judicial Magistrate, Madhepura. This application is, accordingly, rejected.

However, the petitioner, if so advised, may surrender and seek regular bail which will be considered by the learned trial court on its own merit on the same day without being prejudiced by this order of rejection.
