The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419 of the Indian Penal Code and 10 of the Bihar Conduct of Examination Act.

The prosecution case is that one Santosh Kumar @ Munna Kumar was found appearing at the Matriculation Examination, 2016 in place of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner was not aware about Santosh Kumar @ Munna Kumar appearing in his place, hence, if at all, Santosh Kumar is responsible for the alleged offence. A statement has

Patna High Court Cr.Misc. No.20066 of 2016 (2) dt.10-05-2016 2/2 been made in paragraph 3 of the petition that the petitioner has no criminal antecedent and non-grant of bail will jeopardize the career of the petitioner.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 52 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
