Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Nathnagar (Madhusudanpur) P.S. Case No. 97 of 2020 for the offenses under Sections 147, 148, 149, 307 IPC and 27 Arms Act.

Learned counsel for the petitioner would submit that there is no overt act alleged against the petitioner. In the FIR 10 persons have been named and 20 unknown persons have been made accused. There is general and omnibus allegation against the petitioner and nothing specific has been attributed to this

The petitioner is in custody since 16.4.2020. Considering the period of custody and the fact that no one has sustained injury, the court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousand) with two sureties of the like amount each to the satisfaction of the ACJM, 1st Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No. 97 of 2020.
