JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 Petitioners seek bail in anticipation of their arrest in connection with Muffasil P.S. Case No. 77 of 2018, registered for the offences punishable under Sections 448, 341, 323, 324, 307, 354 (B)/34 of the Indian Penal Code.
As per F.I.R niece of the informant was found traceless, later on at the instance of the petitioner no. 1 she was recovered. Further allegation is that petitioners and other accused persons assaulted the informants and others causing serious injuries to him.
Submission of the learned counsel for the petitioners is that there is delay of about more than one month in lodging the F.I.R and there is no specific allegation of assault made

Heard learned A.P.P. also who has opposed the prayer of bail on the ground that injuries sustained by the informant is serious in nature which will appear from the injury report and petitioners have assaulted the informant and others along with other accused.
Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, 1st class, Katihiar in connection with Muffasil P.S. Case No. 77 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
