2. The petitioner has preferred this application for grant of regular bail in connection with Katihar Nagar P.S. Case No. 236 of 2025, dated 11.03.2025 registered for the offences punishable under Section 126(2), 115(2), 109, 117(2), 74, 352, 351(2), 351(3) and 303(2) of the BNS read with Section 3(5) of the BNS.

3. As per the prosecution case, on 11.03.2025, the FIR named accused persons, variously armed, came at the land which belongs to the informant for the purpose of constructing a house, which was objected by informant's mother and sisters. Thereafter, one Subhash Kumar assaulted the sister of informant

Patna High Court CR. MISC. No.37740 of 2025(2) dt.24-06-2025 2/3 namely, Soni Kumari by means of iron-rod on her nose due to which she sustained injury. Thereafter, the co-accused persons assaulted informant's family members and they also snatched a golden chain worth Rs. 1,50,000/-.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to ulterior motive. Both the parties are agnates and there is admitted land dispute between both the parties. The specific allegation of assault is against one Subhash Kumar, who has assaulted Soni Kumari by means of iron-rod on her nose and she has sustained injury which is later found to be grievous in nature. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 12.03.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in

Patna High Court CR. MISC. No.37740 of 2025(2) dt.24-06-2025 3/3 connection with Katihar Nagar P.S. Case No. 236 of 2025.
