JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2015 At the outset, it is submitted that petitioner no.1 has already been arrested, hence, this application has become infructuous so far as it relates to petitioner no. 1. Heard learned counsels for the petitioners and the State.

The petitioner nos. 2 to 8 are apprehending arrest in a case registered for the offences punishable under Sections 147,48,149,323,332,333,307,353,386 and 427 of

Patna High Court Cr.Misc. No.7705 of 2015 (2) dt.26-02-2015 2/3 the Indian Penal Code, section 27 of Arms Act and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that during PACS election protest was made for rejection of nomination of Vishal Kumar when the informant being Election Officer was abused by calling the caste name.

It is submitted by the learned counsel for the petitioners that specific accusation of abusing the informant is against Ram Tapasya Singh and Vishal Kumar. It is further submitted that Ram Tapasya Singh has been granted anticipatory bail vide Cr. Misc. No. 5895 of 2015. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Motihari in connection with Paharpur P.S. Case
