JUSTICE BIRENDRA KUMAR ORAL ORDER 08-03-2017 Heard learned counsel for the petitioner and the State. This criminal writ application is for direction to the respondent authorities to arrest the accused persons of Complaint Case No.1471 of 2013 and also to provide safety and security to the petitioner.

In the counter affidavit the respondents-State have submitted that one of the accused-persons has been granted anticipatory bail by the learned Sessions Judge, Gaya, and another has been granted bail, on surrender, by the learned Court-below and no complaint has been received that the petitioner has any security problem at the hands of the accused persons nor accused has committed any such criminal act, hence, the prayer is infructuous now.

It is further stated that the parties were in business

Patna High Court Cr. WJC No.595 of 2016 (5) dt.08-03-2017 2/2 term and in fact there is business dispute and the allegation has been levelled with intention to harass the accused persons. The submission in the counter affidavit has not been controverted by the petitioner. Hence, this writ application is dismissed as infructuous.
