The petitioner renews his prayer for regular bail in connection with Sasaram (M) PS Case No. 149 / 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2018 inasmuch as earlier the bail application of the petitioner was rejected vide Cr. Misc. No. 35147 / of 2021 by this Court granting liberty to the petitioner to renew his prayer for bail after six months from the date of order if the trial does not record any progress.
The allegation as per F.I.R. is that the police on the basis of secret information that the petitioner along with other accused persons has brought consignment of illicit liquor in a tanker and are planning to distribute it to the local supplier, proceeded towards the place of occurrence and upon seeing the
Patna High Court CR. MISC. No.38704 of 2022(2) dt.03-08-2022 2/3 police party the accused persons fled away and upon search the police recovered 13230 liters of illicit liquor from the said tanker. It is further alleged that one Santro Car bearing Registration No. DL4CP-5722 and a Maruti Car bearing Registration No. BRO1C-8088 were also seized by the police from the place of occurrence.
Learned counsel for the petitioner submits that petitioner is in custody since 05-11-2020 and similarly situated co-accused / Vinod Singh @ Vinod Mahto has been enlarged on bail by this Court vide Cr. Misc. No. 17357 / 2022 (Annexure - 3 to the present petition). He further submits that since the date of last rejection of the prayer for bail by this court the trial has not proceeded further.
Having regard to the submissions made by the parties and taking into consideration the fact that petitioner is in custody since 05 / 11 / 2020 , this is second attempt for bail on behalf of the petitioner and similarly situated co-accused has been granted bail by this Court, and as such, I am inclined to grant regular bail to the petitioner.
Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000/- ( twenty five thousand) with two sureties of the like amount each to the
