JUSTICE SANJAY PRIYA ORAL ORDER 02-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 420, 468 and 506 of the Indian Penal Code.

It has been submitted that the petitioner took the informant to registry office to execute rent agreement but he got executed Mahadnama and he committed cheating with the informant. The Annexure-2 has been filed by the petitioner which is copy of the registered Mahadnama executed by the informant in favour of the petitioner.

In such circumstances, this Court finds that civil remedy is available to the complainant to redress her grievances.

No.21990 of 2016 (7) dt.02-02-2017 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Raxaul P.S. Case No. 34 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Raxaul, East Champaran, at Motihari, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
