JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. At the very outset, learned counsel for the petitioners submits that the petitioner No. 1, namely, Narayan Yadav has already been arrested and accordingly, this petition as against the petitioner No. 1 stands dismissed being infructuous. So far as the petitioner No. 2 namely, Nageshwari Devi is concerned; she apprehends her arrest in connection with Rafiganj P.S. Case No. 176 of 2014 registered for the offence under Sections-304(B), 201/34 of the Indian Penal Code. The petitioner No. 2 is mother-in-law of the deceased and admittedly, the husband and the father-in-law of the
Patna High Court Cr.Misc. No.11550 of 2015 (3) dt.30-04-2015 2/2 deceased have already been remanded to judicial custody. From perusal of the written report of the informant, it would appear that the allegation of demand and torturing is against husband of the deceased.
Accordingly, the petitioner No.
namely, Nageshwari Devi, in the event of her arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rafiganj P.S. Case No. 176 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Aurangabad subject to the conditions as laid down u/S 438(2) of the Cr. P.C.
