The petitioners apprehend their arrest in Samastipur (Mufassil) P.S. Case No. 366 of 2014, registered for the offences punishable under Sections 420, 467, 468 and other Sections of the Indian Penal Code.

The petitioner no. 1 Kanhaiya Kumar Choudhary is Chief Executive Officer of Kisan Krisak Sewa Swablambi Sahkari Samiti and he illegally appointed his brother-in-law Ranjeet Sahani, petitioner no. 2 as agent of the society. Both of them are alleged to have misappropriated a sum of Rs. 3,28,200/-. It is submitted that the petitioners are ready to deposit the aforesaid amount within two weeks.

No.16012 of 2015 (3) dt.01-07-2015 2/2 Considering the facts aforesaid and the fact that if the petitioners deposit the entire amount within two weeks from the date of receipt/production of a copy of this order, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in Samastipur (Mufassil) P.S. Case No. 366 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
