JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 1959 of 2018, disclosing offences under Sections 420, 467, 468 and 120-B of the Indian Penal Code.

Allegation against the petitioner as per the complaint petition is that complainant has purchased 02 Katha and 6-1/2 Dhur of land from Prabha Devi, who got the same on gift from his father and petitioner no.2, who is sister of above Prabha Devi got the same land sold to the petitioner no.1. Submission of learned counsel for the petitioners is that petitioner no.2 is the sister of Prabha Devi and out of 01

No.39681 of 2019(4) dt.05-09-2019 2/3 Bigha 07 Katha land is their father inherits, 02 Katha and 6-1/2 Dhur was gifted to one Prabha Devi, from which, complainant has purchased the same and the boundaries of the deed gifted the western boundaries shown as ancestral whereas the sale deed in the western boundaries mentioned as Rasta and as such, it appears that gift deed was not executed as per the land gifted by the father of said Prabha Devi and with respect to that he has also filed a title suit before the Civil Court. Learned counsel for the opposite party no.2 has also appeared and submitted that he has purchased the same from Prabha Devi, who has got the above land from deed of gift and with respect to that several litigation are going on between the parties and the opposite party no.

2 also wants that same may be resolved by any mediation or any other method. Having heard both sides, in view of the facts as stated above, this application is disposed of with a direction to the petitioner to surrender by 17.09.2019 before the learned court below and on that day, the opposite party no.
