JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-12-2024 Though the present writ petition was filed for quashing the notice dated 05.11.2020, issued by the Circle Officer, Phulwarisharif, District-Patna i.e. the respondent no. 4, however, during the interregnum period, the respondent no. 4 has passed the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, which according to the respondent-State, has already been challenged by the petitioner by filing an appeal bearing Encroachment Appeal Case No. 04 of 2020-21, before the District Magistrate, Patna. 2.

In view of the aforesaid, the learned counsel for the petitioner seeks a direction upon the District Magistrate, Patna to dispose off the aforesaid appeal within a stipulated time

Having regard to the limited prayer made by the petitioner in the present case, I deem it fit and proper to direct the District Magistrate, Patna to conclude the proceedings of the aforesaid Encroachment Appeal Case No. 04 of 2020-21 by passing a reasoned and a speaking order, in accordance with law, within a period of four weeks of receipt/production of a copy of this order, in case the final order has not yet been passed.

The writ petition stands disposed off on the aforesaid terms.
