JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-04-2022 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner has renewed his prayer for bail in connection with Ramnagar P.S. Case No. 146 of 2020 registered for the offence punishable under Section 304B read with 34 of the Indian Penal Code. Her prayer for bail was earlier rejected by this Court vide order dated 20.01.2021.

Learned counsel for the petitioner submitted that the petitioner being mother-in-law is in custody since 08.05.2020. The charges in the case has been framed on 31st of March, 2022 and till date no witness has been examined.

Learned counsel for the State and learned counsel for the informant have opposed the prayer for bail. However, they

Considering the totality of the circumstances, the period undergone by the petitioner in custody as an under trial prisoner as well as the fact that till date no witness has been examined, I am inclined to grant bail. She is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bagaha, West Champaran in connection with Ramnagar P.S. Case No. 146 of 2020.
