2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 366/34 of the Indian Penal Code.
3. As per the prosecution, F.I.R. has been lodged against five named accused persons alleging that they have kidnapped the informant's daughter with a view to marry.
4. Learned counsel for the petitioner submits that the alleged victim girl has been recovered and she has recorded her statement before the Magistrate under Section 164 of Cr.P.C. in which she has narrated that she is major and she went with her maternal grand mother's house. Victim girl also submits that her marriage has been solemnized with the petitioner and presently
Patna High Court CR. MISC. No.41110 of 2023(2) dt.28-07-2023 2/2 they are living happily together. Counsel further submits that antecedent of the petitioner is clean.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. In the present facts and circumstances, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond to the satisfaction of learned A.C.J.M.-IV, Munger in connection with Kharagpur P.S. Case No. 226 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.. (Dr. Anshuman, J.) ravishankar/- U T
