Heard learned counsels for the petitioner and the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code. It is alleged that the petitioner being the contractor who supplied rice under Mid-Day-Meal Scheme to 25 Schools, misappropriated 532 quintals of rice.

It is submitted by learned counsel for the petitioner that document on record to suggest that 300 quintals rice were supplied to various schools for which receiving was given to the petitioner and

Patna High Court Cr.Misc. No.11798 of 2015 (2) dt.23-03-2015 2 / 2 the petitioner is ready to make supply of rest 232 quintals of rice. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

Considering the stand of the petitioner, let the petitioner, above named, be released on provisional anticipatory bail for three months, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Chenari P.S. Case No. 141 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Rohtas at Sasaram, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

On supply of balance rice of 232 quintals to the appropriate authority, the provisional bail of the petitioner will be confirmed by the learned court below.
